These Terms & Conditions ("Terms") govern your booking and participation in experiences offered by Aqua Elite Events INC, doing business as Prime Experiences and Prime Luxury Rentals ("we", "us", "our"). By booking an experience, paying a deposit, or using experiences.primeyachtsmiami.com (the "Site"), you agree to these Terms.

1. Bookings & Deposits

A non-binding inquiry becomes a confirmed booking only once we accept it in writing and the deposit is paid in full.
Deposits ($500 for Standard, $1,000 for Signature, or as otherwise quoted) secure the date and vessel and are applied to the final balance.
The final balance is due no later than 48 hours before the scheduled experience unless we agree otherwise in writing.
All prices are quoted in US Dollars (USD). Applicable taxes and fees, where required, are added at checkout or to the final balance.

2. Cancellations & Refunds

Full refund of the deposit if you cancel 14 or more days before the scheduled experience.
Non-refundable if you cancel within 13 days of the scheduled experience.
Weather: if we determine that weather, sea conditions, or safety concerns require cancellation, you will receive either a full refund of all amounts paid or the option to reschedule at no additional cost.
No-shows and late arrivals beyond 30 minutes without prior notice forfeit the deposit and any payments made.
Refund requests must be submitted in writing to info@primeluxuryrentals.com. Approved refunds are processed via the original payment method within 5–10 business days.

3. Changes & Rescheduling

Rescheduling requests made 14+ days in advance are accommodated subject to availability at no charge. Requests inside 13 days are at our discretion and may incur additional fees.

4. Guest Conduct & Capacity

Guest counts may not exceed the vessel's Coast Guard capacity (typically up to 13 guests).
The captain has sole authority over the vessel and may end an experience early without refund if guests act unsafely, illegally, or disrespect crew.
Smoking is permitted only in designated areas. Illegal substances are strictly prohibited.
Soft-soled shoes only on deck. Damages caused by guests are billed to the booking party.

5. Alcohol

Beverages listed in each experience are included. BYOB is permitted on most charters where lawful. No alcohol may be served to guests under 21 years of age. The captain may refuse service at any time.

6. Assumption of Risk & Liability Waiver

You acknowledge that yacht charters, watersports, and water-based activities carry inherent risks including but not limited to slips, falls, weather changes, motion sickness, and drowning. You voluntarily assume all such risks. To the maximum extent permitted by law, you release and hold harmless Aqua Elite Events INC, its owners, employees, captains, crew, and affiliates from any claim, loss, or damage arising from participation, except for damages caused by gross negligence or willful misconduct.

7. Intellectual Property

All content on the Site (text, images, videos, logos) is owned by us or licensed to us and may not be reproduced without written permission. Photographs and video taken during experiences may be used by us for marketing unless you opt out in writing before the experience.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to your booking shall not exceed the amount you paid for the experience giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Force Majeure

We are not liable for delays or failure to perform caused by events beyond our reasonable control, including severe weather, government action, port closures, equipment failure, labor disputes, pandemics, or acts of God.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You waive any right to a jury trial and to participate in a class action.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site or any booking made after changes are posted constitutes acceptance.
